Terms and Conditions for the "$1/Day Website Campaign"
1. Definitions and Overview
Definitions:
Service: The website creation and hosting offering provided under the "$1/Day Campaign."
Customer: Any individual or entity that signs up for the Service.
Website: The digital platform provided to the Customer, initially a 5-page static website.
Additional Services: Any custom modules, bespoke website designs, or optional add-ons not included in the standard offering.
Licensed Images: Images that are legally obtained under proper licenses to ensure no copyright infringement.
Content: All text, images, graphics, audio, and video files provided or created as part of the Service.
Overview: These Terms and Conditions ("Terms") govern your participation in our "$1/Day Campaign" offer. By registering for this offer, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.
2. Service Description and Pricing
Standard Service Offering:
For a rate of $1 per day (billed annually at approximately $365 per year), the Customer is provided with a professionally designed, 5-page static website.
This Service includes professional content creation at no extra cost. All images used are licensed, ensuring compliance with copyright laws.
Hosting is included in the price; however, domain name registration fees are not included and must be arranged and paid separately by the Customer.
Optional Additional Services:
The Customer may enhance their website with additional modules or a fully custom website design for an extra fee.
Any additional services will be outlined in a separate agreement detailing the scope, timeline, and pricing.
Please note: Logo design or any other graphic design costs beyond the standard website content creation are not included in this offer.
Media and Copyright Compliance:
We use only Licensed Images. No images sourced from unsecured resources (such as Google) that may be copyright protected will be used.
All content provided is either created specifically for the Customer or legally sourced from authorized resources.
3. Payment Terms and Billing
Billing Cycle and Payment Process:
Payments for the Service must be made on an annual basis.
The fee of approximately $365 per year (equivalent to $1 per day) is billed upfront unless another annual payment arrangement is made.
Additional Fees for Optional Services:
Any extra modules or customizations requested by the Customer will incur additional charges after a prior agreement.
A detailed estimate for any additional work will be provided and must be accepted before proceeding.
Refund Policy:
All fees paid are non-refundable.
In the event of early cancellation (see Section 7), no refund will be issued for the remaining period of the billing cycle.
Modifications to Fees:
Akshari Solutions reserves the right to modify the pricing for the Service. Customers will be notified at least 30 days prior to any price changes.
4. Licensing and Intellectual Property
Website Code and Proprietary Tools:
The Customer is granted a non-exclusive, non-transferable license to use the website as long as the Service remains active.
All underlying code, software, and proprietary tools remain the exclusive property of Akshari Solutions.
At no time will the website code or proprietary materials be provided, disclosed, or sold to the Customer, even if the Service is cancelled or terminated.
Intellectual Property Rights of Content:
All content created for the website is licensed for use by the Customer within the Service.
Ownership of images, graphics, and text remains with the respective rights holders or with Akshari Solutions if created in-house, ensuring full copyright compliance.
5. Modifications and Customizations
Standard Service Limitations:
The basic "$1/Day" offering is specifically for a 5-page static website.
Requests for additional pages or interactive features beyond the standard offering will be treated as customizations and will incur extra fees.
Process for Customizations:
Requests for additional services must be submitted in writing.
Upon receiving a request, Akshari Solutions will provide a detailed proposal outlining the scope, timeline, and cost before any work begins.
No work on customizations will commence until both parties have agreed in writing to the terms.
6. Customer Obligations and Use
Accurate Information:
The Customer must provide accurate and up-to-date information during signup and in future communications.
Failure to provide correct information may result in delays or termination of the Service.
Proper Use of the Website:
The Customer agrees not to use the website for any unlawful, misleading, or fraudulent purposes.
The Customer is responsible for ensuring that any content provided does not violate any third-party rights or applicable laws.
Content Review:
The Customer will have the opportunity to review and request changes to the content and design during the development process.
Final approval is required before the website is published.
7. Cancellation and Termination
Cancellation Terms:
Cancellation of the Service may be requested at the end of any annual billing cycle.
Cancellation requests during an active billing cycle will not result in a refund for the remaining period.
Termination for Cause:
Akshari Solutions reserves the right to immediately terminate the Service if the Customer violates any of these Terms, including misuse of the website or providing false information.
In cases of termination for cause, the Customer will not be entitled to a refund.
Effect of Termination:
Upon termination, the Customer’s license to use the website ceases immediately.
All access to the website and related services will be revoked, and no refund will be given for subsequent periods.
8. Limitation of Liability and Disclaimers
General Disclaimer:
The Service is provided "as-is" and "with all faults." Akshari Solutions does not guarantee uninterrupted, error-free, or completely secure service.
Limitation of Liability:
In no event shall Akshari Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether in contract, tort, or otherwise, even if advised of the possibility of such damages.
Force Majeure:
Akshari Solutions shall not be held liable for any delay or failure in performance due to events beyond its control, including acts of nature, government restrictions, or other unforeseeable circumstances.
9. Amendments and Modifications
Right to Amend:
Akshari Solutions reserves the right to modify these Terms at any time.
Notice of material changes will be sent to the Customer’s registered email address at least 30 days prior to the amendments taking effect.
Customer Acceptance:
Continued use of the Service after any amendments constitutes the Customer’s acceptance of the modified Terms.
10. Governing Law and Dispute Resolution
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Akshari Solutions operates.
Dispute Resolution:
Any disputes arising from these Terms or the Service shall first be resolved through amicable negotiation between the parties.
If an amicable resolution cannot be achieved, disputes shall be submitted to binding arbitration under the rules of the designated arbitration body. The arbitration decision will be final and binding.
11. Notices and Communication
Method of Communication:
All notices required or permitted under these Terms shall be in writing and delivered via email or postal service to the contact details provided by the Customer.
Updates and Announcements:
Akshari Solutions may occasionally send updates or other communications related to the Service. The Customer agrees to receive such communications as part of the Service.
12. Entire Agreement and Severability
Entire Agreement:
These Terms, including any referenced policies or agreements, constitute the entire agreement between the Customer and Akshari Solutions regarding the Service, superseding all previous agreements.
Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
